Security Deposit Return Records for Texas Renters

Lease decisions

Keep condition evidence, surrender details and a written forwarding address in one move-out file.

Start with the original condition

Save the move-in inspection, dated photos, repair requests, and lease. Before leaving, photograph the same areas after belongings are removed. Include floors, walls, appliances, fixtures, and existing damage rather than only wide room views.

Keep cleaning and repair receipts if relevant. Do not assume paying for a service proves the apartment met every contractual requirement. The useful comparison is the documented condition at arrival and surrender.

Record surrender and the forwarding address

Ask how to return keys, fobs, remotes, and parking devices, and obtain a receipt. Keep the move-out notice and confirmation. Provide a written forwarding address for the deposit and retain evidence it was sent.

The Texas State Law Library explains the general requirement to refund a deposit within 30 days after surrender, alongside the rule that the landlord is not obligated to refund or provide a damage statement until a written forwarding address is given. Details and exceptions matter; do not calculate a disputed deadline from moving-truck day alone.

Review the accounting against evidence

The library explains that normal wear and tear cannot be deducted and that deductions must relate to charges for which the tenant is legally liable. It also describes requirements and exceptions for itemized accounting.

Compare each deduction with the lease, condition records, and payment ledger. Request an explanation of unclear entries in writing. Keep the envelope or delivery date with any statement you receive. If you dispute withholding, seek advice on the appropriate demand or legal process rather than assuming every late or missing payment creates the same remedy. This file is useful because it preserves specific evidence, not because photographs or a checklist guarantee a full refund.
