Month-to-Month or Fixed-Term Lease: Which Fits?

Match the agreement to your timeline, then verify the notice rules and price in writing.

Start with your likely departure

A fixed-term lease sets a stated rental period. A month-to-month arrangement continues monthly under its applicable terms. Neither label establishes the complete cost or tells you exactly how to leave.

Write down your earliest and latest likely departure dates. If work, school, or a home purchase could change your plans, make that uncertainty part of the comparison. Ask for the actual documents and a written price for each offered option.

Price flexibility rather than assuming its value

Compare recurring charges, short-term premiums if quoted, concessions, deposits, and move-out requirements. Check whether a discount depends on completing a particular term. Do not assume that monthly occupancy always costs more or that a longer term guarantees a discount.

For a fixed term, ask about expiration, renewal, and early-exit options. For month-to-month occupancy, ask how price changes and termination notices work. Record the answer beside the price.

Read the notice framework carefully

The Texas State Law Library explains that a monthly tenancy generally ends on the later of the date stated in the notice or one month after notice, for rental periods of at least one month. A signed agreement can provide different notice terms. This is not a universal rule requiring departure at the next calendar month-end.

Fixed-term move-out notice depends on the agreement. Read it before reserving movers. Compare a plausible early departure under both choices, including any unresolved liability, rather than assuming flexibility means you can walk away without further payments. Get advice if a notice clause or termination right is disputed.

Keep the flexibility you need separate from the flexibility being sold. A shorter term is useful only if its actual notice and exit conditions fit your plans.
