Photo Permission Checklist for Apartment Listings
Published by Apartments Texas · Updated
Check image rights, property match and truthful captions before adding photos to a listing.
Verify permission, not only access
For each image, record who supplied it, the photographer or rights holder if known, and the permission or license covering your intended use. A file in a shared folder or a photo visible on another website is not proof of permission to republish it.
The U.S. Copyright Office explains that original photographs receive copyright protection when created and that the photographer is generally the initial owner, subject to exceptions such as qualifying works made for hire. Owning or managing the building does not by itself establish ownership of every photograph of it.
Check the scope and the subject
Confirm whether the permission covers website publication, edits, crops, marketing, duration, and any required credit. Keep the actual approval or license, not merely a filename saying approved. Ask about uncertainty before publication; attribution is not a substitute for permission.
Match the photograph to the exact property and branch. Identify model units, selected finishes, exterior views, and shared facilities accurately. Inspect for people, private information, license plates, or sensitive access details and obtain appropriate review before use.
Publish with honest context
Do not use a renovated model to imply every apartment has the same finishes. The FTC cautions rental businesses against misleading claims about property conditions and services. Captions and surrounding copy should not turn a truthful photo into a false promise.
Retain the original, the publication version, the rights record, and the property mapping. Check the final crop on a phone so important context is not cut away. If permission expires or is challenged, have a clear removal owner. This checklist does not decide legal fair-use questions; seek qualified advice where rights are disputed instead of treating a publicly downloadable image as free inventory.
